Asbestos Compliance Check

Are you a duty holder?

The duty to manage covers all non-domestic premises. Such premises include all industrial, commercial or public buildings such as factories, warehouses, offices, shops, hospitals and schools.

Non-domestic premises also include those 'common' areas of certain domestic premises: purpose-built flats or houses converted into flats. The common areas of such domestic premises might include foyers, corridors, lifts and lift-shafts, staircases, roof spaces, gardens, yards, outhouses and garages - but would not include the flat itself. Such common areas would not include rooms within a private residence that are shared by more than one household such as bathrooms, kitchens etc in shared houses and communal dining rooms and lounges in sheltered accommodation.

If you have already had an asbestos inspection conducted you should have information to help implement the asbestos management plan. However, this is not where your obligations end. As the duty holder you must regularly review the management plan to assess the condition of any ACM's (Asbestos Containing Materials) and also demonstrate that you are complying with the current regulations. Q3: Have you checked or do you know if asbestos is present in your premises or on your site?



Q4: If you know that asbestos is present in your premises or on your site do you have a record of the condition of the asbestos containing materials, or materials which are presumed to contain asbestos?

Q6: If you do not have an asbestos report do you know what type of survey is required to ensure you comply with current asbestos regulations (Control of Asbestos Regulations 2012).



Q7: If you have had an asbestos survey carried out for your premises/site have you undertaken a periodical review and monitored the plan and the arrangements to act on it so that the plan remains relevant and up-to-date? (Current regulations - Control of Asbestos Regulations 2012).



Q8: If you have an existing report is it clear and easy to understand by anyone who will be required to read it?
